Terms of Business
These terms of business are set out on the basis which B.O.K. Financial Services Ltd will provide business services to you as an individual private client of the firm. Please take a few minutes to read through these and if you have any questions I will be happy to answer them.
B.O.K. Financial Services Ltd is regulated by the Central Bank of Ireland as a Multi Agency Intermediary and a copy of the firms Statement of Authorised Status from the Central Bank is attached. A list of the product producers from whom the firm holds written letters of appointment are also attached. (You should ask for a copy of these items if they are not attached.)
In relation to products provided by the product producers listed, the services which the firm is authorised to provide are:
a) Advising you in relation to the nature of each of the products and advising you as to which product is suitable for your needs;
b) Receiving and transmitting orders on your behalf for a product (s).
The products for which B.O.K. Financial Services Ltd have appointments for to act in relation to include policies for specified serious illness, life assurance, pensions, tracker bonds, deposits, savings and investments.
B.O.K. Financial Services Ltd may receive commission and other payments from the product producer to whom orders are transmitted. Summary details of these payments will be included in a product information document, which you are legally entitled to receive before an application for a product is completed, and full details will be included with your cooling off letter.
Some lenders may charge you a fee but B.O.K. Financial Services Ltd will advise you of this prior to Offer Letter. Please also note in certain circumstances we may charge you a fee for the service provided. If we do this we will provide you with a written estimate of this in advance of providing any business services.
Where B.O.K. Financial Services Ltd have been instructed to secure a Mortgage on your behalf and where either of the following situation arises:-
a) The issue of an official approval from the Lending Institution or
b) In the event of a rejection from the specific lender due to an unacceptable credit history which is not disclosed or in the event that the rejection is as a result of non-disclosure of relevant information
a standard fee of 0.5% of the loan amount will be our fee and this amount will fall due on receipt of an official approval/rejection regardless of whether the Borrower proceeds to take up the Mortgage.
B.O.K. Financial Services Ltd agree however to waive the above mentioned fee in the event that you proceed with the Mortgage the subject matter of the loan approval and fully drawdown the loan.
In the event of the Mortgage the subject matter of this application being redeemed by you any time within three years of its issue you will be liable to pay to B.O.K. Financial Services Ltd that percentage of the Brokerage fee repayable by B.O.K. Financial Services Ltd to the original Mortgage Provider as a result of the cancellation of the said Mortgage. This sum will be payable within fourteen days of the redemption of the original Mortgage.
It is the policy of the firm to avoid any conflict of interest where providing business services to clients. However, where an unavoidable conflict may arise we will advise you of this in writing before proceeding to provide any business service. If you have not been advised of any such conflict you are entitled to assume that none arises.
B.O.K. Financial Services Ltd will, if necessary, exercise its legal rights to receive any payment’s due to it from clients for business services provided by it and, to be reimbursed for any value obtained by the firm for clients arising from payments by the firm on behalf of clients who subsequently default in any payment due to the firm.
Product producers may withdraw benefits or cover on default of any payments due under any products arranged for your benefit. Details of these provisions will be included in your product terms and conditions.
Any complaint that you may have in relation to the business services provided should be made in writing to the firm outlining the nature of your complaint. Any such complaint will be acknowledged within 5 days. The complaint will be fully investigated by B.O.K. Financial Services Ltd and a full response will be provided to you. We will aim to provide this response not later than one month from receipt of your complaint. In the event that you remain dissatisfied with the firms handling and response to your complaint you are entitled to refer your complaint to the Insurance Ombudsman.
B.O.K. Financial Services Ltd is a member of the investor compensation scheme, which provides certain remedies to eligible clients on default by the firm. The main details are available on request.
